Welcome to MyPerfumes! The terms “we”, “us” and “our” refer to MyPerfumes. MyPerfumes operates this shop and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a tailored shopping experience (the “Services”). MyPerfumes is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with the policies referred to herein (these “Terms and Conditions” or “Terms”), describe your rights and obligations when you use the Services.

We have made every effort to display our products and Services in our online stores as accurately as possible. However, colours or the appearance of products may differ from those shown on your screen depending on the device you use and its settings.

We do not warrant that the appearance or quality of products or Services purchased by you will meet your expectations or correspond exactly to the representations in our online stores.

All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to discontinue products at any time and, on a case-by-case basis, to limit the quantities of products offered to any person, geographic region or jurisdiction.

Section 3 – Orders

By placing an order, you make an offer to purchase. MyPerfumes reserves the right, at its sole discretion and for any reason, to accept or reject your order. Your order is not accepted until it has been confirmed by MyPerfumes. Receipt and processing of your payment is a condition of acceptance. Please review your order carefully before submitting it, as MyPerfumes may be unable to accommodate cancellation requests after an order has been accepted. If we do not accept, change or cancel an order, we will attempt to notify you using the email address, billing address and/or telephone number provided at the time of order.

Returns or exchanges of purchases are handled solely in accordance with our Refund Policy.

You represent and warrant that your purchases are intended for personal or household use and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts and special offers may change without prior notice. The price charged for a product or Service will be the price in effect at the time the order is placed and will be stated in the order confirmation sent to you by email. Unless expressly stated otherwise, displayed prices do not include taxes, shipping, handling, customs or import charges.

Prices shown in our online stores may differ from prices in physical stores or in online stores or other shops operated by third parties. From time to time, we may offer promotions relating to the Services which may affect pricing and may be subject to separate terms. In the event of a conflict between the terms of a promotion and these Terms, the promotion terms shall prevail.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made through our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiry dates, so that we can complete transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct and complete, (ii) you are authorised to use the relevant credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay all charges at the stated prices, including shipping and handling fees and all applicable taxes.

Section 5 – Shipping and Delivery

We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control. Once products are handed over to the shipping carrier, title and risk of loss pass to you, subject always to any mandatory consumer rights that apply under applicable law.

Section 6 – Intellectual Property

Our Services, including without limitation all brands, trademarks, text, displays, images, graphics, product reviews, video and audio files, and their design, selection and arrangement, are owned by MyPerfumes, its affiliates or licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material from the Services. Except as expressly provided, nothing in these Terms grants or shall be construed as granting any licence or other right under any patent, trademark, copyright or other intellectual property right of MyPerfumes, Shopify or any third party. All rights not expressly granted are reserved by MyPerfumes.

The names, logos, product and service names, designs and slogans of MyPerfumes and, where applicable, Arabiyat Prestige, are trademarks of their respective owners, affiliates or licensors. They may not be used without prior written permission. Shopify names, logos, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans appearing in the Services are the trademarks of their respective owners.

Section 7 – Optional Tools

You may be given access to customer tools offered by third parties as part of the Services which we do not monitor and over which we have no control or input.

You acknowledge and agree that access to such tools is provided “as is” and “as available” without warranties, representations or conditions of any kind and without endorsement. We disclaim liability arising from or relating to your use of optional third-party tools to the extent permitted by law.

Any use by you of optional tools offered through the website is entirely at your own risk and discretion. You are responsible for familiarising yourself with and accepting the terms on which the relevant third-party providers make such tools available.

We may also offer new features through the Services in the future, including new tools and resources. Such new features will be treated as part of the Services and will be subject to these Terms and Conditions.

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality. Section 9 – Relationship with Shopify

MyPerfumes is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through our store are concluded directly with MyPerfumes. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of transactions between you and MyPerfumes, including injury, damage or loss arising from products or services purchased. To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising from or relating to purchases and transactions with MyPerfumes.

Section 10 – Privacy Policy

All personal data that we collect through the Services is subject to our Privacy Policy. Certain personal data may also be subject to Shopify’s privacy policy. By using the Services, you confirm that you have read these privacy policies.

We are not obliged to keep Feedback confidential, compensate you for Feedback or respond to Feedback.

We reserve the right to monitor, edit or remove Feedback that we, in our sole discretion, consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes intellectual property rights or these Terms.

You warrant that your Feedback does not violate any third-party rights and is free from computer viruses or other malware. You may not use a false email address, impersonate another person, or mislead us or third parties as to the origin of Feedback. You are solely responsible for your Feedback and its accuracy.

From time to time, information in or relating to the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping charges, transit times and availability. Except as expressly stated by MyPerfumes and subject to mandatory consumer rights, the Services and products offered through them are provided on an “as is” and “as available” basis without additional express or implied warranties.

To the fullest extent permitted by applicable law, MyPerfumes and related parties shall not be liable for indirect or consequential losses, including loss of profits, arising in connection with your use of the Services. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Section 17 – Indemnification

To the extent permitted by applicable law, you agree to indemnify MyPerfumes, Shopify and their affiliates against third-party claims arising from your material breach of these Terms or unlawful use of the Services.

If any provision of these Terms is found to be unlawful, void or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.

Section 19 – Waiver; Entire Agreement
